The data controller and processor of Personal Data within the framework of the Website and for selling products is, unless explicitly described otherwise, the sole proprietorship The Vegan Saint, trading under the name The Vegan Saint. This also includes third parties hired by The Vegan Saint.

Below is an overview of which Personal Data we may collect from you in each specific situation.

Directly provided information

If you purchase Products from The Vegan Saint, we always request the following information from you: first name, last name, postal and billing address, payment details, telephone number, and email address. If the recipient is not the sender, we ask for the name, address, place of residence, and telephone number of the recipient. If you contact us online or offline, we may collect the following information from you, such as first name, last name, postal address, telephone number, and email address.

Special and criminal Personal Data

The Vegan Saint does not process special or criminal Personal Data and also does not intend to collect data about or sell Products to persons under 16 years of age, unless consent has been obtained from parents or guardians. However, The Vegan Saint cannot check whether a Visitor is over 16 years old and therefore advises parents to be involved in their children's (online) activities to prevent data about children from being processed without parental consent. If you are convinced that The Vegan Saint has collected personal data about a minor without such consent, please contact us via info@thevegansaint.nl and The Vegan Saint will delete this data.

The Vegan Saint may collect information about you from other companies and organizations, including social media like Instagram Shopping. We may collect publicly available information. For example, we may collect public information about you when you interact with us through social media. By collecting additional information about you, we can correct inaccurate information and provide you with appropriate advice.

Aggregated information

Anonymized and aggregated information does not identify a specific person and therefore cannot be traced back to an individual. The Vegan Saint uses such information for, among other things, insight into Website visits and data analysis.

4. Legal Basis for Data Processing

According to the GDPR, every processing of Personal Data must be based on one of the legal grounds. The Vegan Saint processes your data based on the following legal grounds:

Consent

Through requests by email or other social media, orders via the Website, and newsletter subscriptions, this consent is obtained via a link to this Privacy and Cookie Statement that the Data Subject must check for agreement. If third parties process your data on behalf of The Vegan Saint ('sub-processors'), your explicit consent will be requested in writing and prior to this processing. If you have given consent for the processing of your Personal Data, you can withdraw it at any time by emailing info@thevegansaint.nl. In this case, the processing of Personal Data before the moment of withdrawal remains lawful based on previously given consent.

Legitimate interest

The Vegan Saint may have a legitimate interest in processing your Personal Data, for example, for marketing purposes. The interest can therefore vary per data processing. The Vegan Saint always weighs its own interest against the interests of you as the data subject.

Performance of the agreement In the context of the performance of the agreement between The Vegan Saint and its customers, it is necessary to process Personal Data to prepare and send your order.

5. Purposes of data processing

The Vegan Saint processes personal data for practical reasons such as:
- executing the agreement and communicating with its Customers in the broadest sense (Outlook)
- enabling online payments via a payment system (Mollie)
- maintaining administration and invoicing;
- sending the order you placed (My Parcel)
- keeping its business in good (legal) standing;
- sending newsletters and automated emails (Mailchimp);

Real-time insight

Received orders are stored in the website environment and linked via an API plug-in to our shipping service. This allows you to view our stock via real-time data and be informed when your order is delivered.

Account

It is possible to create an account on the Website. For this purpose, the data you provide, such as name, address, email address, and phone number, are linked to an account. In the account, you can view your order history and provided data, and also place new orders. After closing the account, this data is immediately deleted.

Newsletter

The Vegan Saint sends newsletters to its customers and individuals who have subscribed. Name and email address are processed for this purpose. It is possible to unsubscribe at any time. Once unsubscribed, the aforementioned data will be immediately deleted. Furthermore, processing also ensures optimal use of the Website (www.thevegansaint.nl) and is based on commercial considerations such as marketing purposes and gaining insight into (unique) visitor numbers and other statistics. The Vegan Saint also processes Personal Data to contact you and other suppliers, instruct suppliers, and/or to respond to a question/request. For managing and optimizing (monitoring, posting messages, and responding to reactions) social media accounts as well as placing advertisements, for insight into

Website visitors and search behavior, to optimize the Website.

Other interests

- developing and improving new Products;
- assessing the effectiveness of our sales, marketing, and advertising;
- in case of a security or product issue, reporting it to the relevant authorities;
- complying with applicable legislation and reporting on it;
- complying with legal obligations and our policies;
- initiating or defending a legal claim.

6. Storage

Your Personal Data will not be stored on our mail servers and in the backend of our Website longer than necessary to achieve the purposes described above. The Vegan Saint may store your Personal Data for longer based on a (legal) obligation and taking into account any limitation periods. Your Personal Data will be stored by The Vegan Saint for a minimum of two years and a maximum of seven years.

- Data such as first and last name, address, and email address are used for administrative and financial purposes. This data is stored for seven years because The Vegan Saint is legally obliged to store this data for seven years for the tax authorities. This also applies to email addresses and the content of emails.

- For commercial interest, The Vegan Saint uses data such as your (company) name, first and last name, and email address for direct marketing.

7. Processing of Personal Data by third parties

Your Personal Data may in certain cases be provided to third parties. This includes, for example, Google and social media. Your Personal Data may be shared by The Vegan Saint with suppliers who provide services to us, such as business, professional or technical support functions. Please note! Now that the Court of Justice of the EU has declared the EU-US Privacy Shield invalid in the Schrems II judgment, there is uncertainty about the practical consequences of this when using providers in the United States. This also applies to The Vegan Saint, as we use Facebook, LinkedIn, and Instagram, among others. We are investigating how we can comply with the laws and regulations in our business operations and are also keeping up with developments. As soon as the European Data Protection Board (EDPB) issues guidance with additional measures, this Privacy and Cookie Policy will be adjusted where necessary. 9. Your rights You have the right at all times to lodge a complaint or objection regarding the way in which The Vegan Saint processes your Personal Data, as well as to access, erase, rectify, supplement, port, restrict the processing of, or delete your Personal Data. This can be done in writing or by emailing info@thevegansaint.nl. We will ask you to provide us with specific information so that we can confirm your identity. This is a security measure to ensure that your personal data is not disclosed to anyone who does not have the right to receive it. Below you will read what the aforementioned rights entail.

- Access
You have the right at all times to access your Personal Data. The right of access only concerns access to your own data. You can at any time request access to your personal information, including a copy of the Personal Data that The Vegan Saint has processed or is still processing about you. It is possible that your data has since been deleted, anonymized, or is no longer available due to laws and regulations. In that case, The Vegan Saint will inform you immediately with the reason why.
- Right to be forgotten
If there is no longer a legal basis for The Vegan Saint to hold your Personal Data, you can submit a request to erase your Personal Data. You also have the right to ask The Vegan Saint to erase or delete your data if you have successfully exercised your right to object to processing, if you are under 16 years old and the Personal Data was collected via our Website, if The Vegan Saint may have unlawfully processed your data, or if we need to erase your Personal Data to comply with laws and regulations. 10. Security
The Vegan Saint takes appropriate technical and organizational measures to secure obtained Personal Data. The Vegan Saint uses equipment and software to continuously secure its systems and the Website with antivirus software that complies with the current state of the art. The online programs used by The Vegan Saint are all password-protected, and these passwords are changed regularly. The plugins used for the Website are all up-to-date at all times. Backups are also made regularly.

As previously mentioned in the Privacy Statement, The Vegan Saint is aware that the ruling of the Court of Justice of the EU of July 16, 2020, has implications for the transfer of Personal Data via Google Analytics, and we are looking for a solution for this. Privacy is a very important asset to us, and we are therefore doing our utmost.

Targeted advertising by third parties
The Vegan Saint uses third-party analytics and tracking tools, such as Google AdWords and Facebook Ads, to track, segment, and analyze the use of The Vegan Saint services and advertisements. This includes determining demographics and interests. Based on this, we can provide you with more (online) targeted advertising.
